"Lakepedia.com", the "Website", "us", "we" or "our" means Lakepedia Media SRL, a limited liability company incorporated under the laws of Romania, and having its registered address in Cluj-Napoca, Romania.

"Content" means any piece of information that can be found on the Website, including lake descriptions, photos, reviews, things to do, nearby places, and weather reports.

"Interactive Areas" means any section on the Website where users can contribute content, including lake reviews, traveler accounts, and business accounts.

"Service" means the business advertising service, and the act of displaying the Content on the Website.

"Member" or "Membership" means the traveler account or the business account that can be created on Lakepedia.

2. Your Agreement to These Terms

By accessing or using this Website in any manner, you agree to be bound by the Agreement and represent that you have read and understood its terms. Please read the Agreement carefully, as it contains information concerning your legal rights and limitations on these rights. If you do not accept all of these terms and conditions, please do not use this Website.

3. Modifications to these Terms

We may change or otherwise modify the Agreement in the future, and you understand and agree that your continued access or use of this Website after such change signifies your acceptance of the updated or modified Agreement. 4. Eligibility to Use Services

As a condition of your use of this Website, you warrant that:

(ii) if you have a Lakepedia account, you will safeguard your account information and will supervise and be completely responsible for any use of your account by anyone other than you.
(iii) you are 18 years of age or older in order to register for an account and contribute to our Website. Lakepedia does not knowingly collect the information of anyone under the age of 18.

We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of this Agreement.

Use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by this reference.

6. Lakepedia Ownership Rights

Unless stated otherwise, the content and information on this Website (including, but not limited to data, information, text, photos, graphics, video, code or other material), is proprietary to us or is under the CC0 public domain license. As between you and us, Lakepedia owns all right, title, and interest in and to the Site, the Services, and the Content, all of which are protected by copyright, trademark, patent, trade secret and other laws and treaties worldwide. Lakepedia reserves all rights in the Site, the Services, and the Content.

7. Prohibited Activities

If you distribute, transmit, display, reproduce, publish, create derivative works from the Website, you agree to credit Lakepedia by placing a hyperlink to the homepage or to the referenced page or by mentioning Lakepedia. (ii) access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission.
(iii) violate the restrictions in any robot exclusion headers on this Website or bypass or circumvent other measures employed to prevent or limit access to this Website.
(iv) take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on the infrastructure that supports the Website.
(v) "frame", "mirror" or otherwise incorporate any part of this Website into any other website without our prior written authorization.

This Website may contain review services in which you or third parties may post reviews of travel experiences or other content, messages, materials or other items on this Website. If Lakepedia provides such Interactive Areas, you are solely responsible for your use of such Interactive Areas and use them at your own risk.

9. Rights in Content You Submit

Please be aware that by submitting content to this Website by email, postings on this Website or otherwise, including any reviews, photographs, or any other type of content, you grant Lakepedia a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sublicensable right to (a) use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Submissions throughout the world in any media, now known or hereafter devised, for any purpose; and (b) use the name that you submit in connection with such Submission. You acknowledge that Lakepedia may choose to provide attribution of your comments or reviews at our discretion. You represent and warrant that: (a) the Content is your original work or you otherwise own the Content or have all rights necessary to grant the rights and licenses set forth in these Terms, and (b) the posting of the Content on, through or in connection with the Services and the granting of the rights in these Terms do not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. You agree to pay for all royalties, fees, and any other monies owing any person or entity by reason of Lakepedia’s exercise of the rights granted in any Content posted by you or anyone else through your Membership account.

10. Inappropriate and Prohibited Content

Lakepedia has no obligation to review or moderate the Content or any information or content submitted by other Users. However, we reserve the right, in our sole discretion, to reject, refuse to post or remove any posting by you or others or any Content or other Users’ content for any or no reason, with or without prior notice or explanation, and without liability.

Lakepedia is not liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. As a provider of interactive services, Lakepedia is not liable for any statements, representations or Content provided by its users in any public forum, personal home page or other Interactive Area. By using any Interactive Areas, you expressly agree not to post, upload to, transmit, distribute, store, create or otherwise publish through this Website any of the following:
a. Content or links to content that, in the sole judgment of Lakepedia, (a) violates the previous subsections herein, (b) is objectionable, (c) which restricts or inhibits any other person from using or enjoying the Interactive Areas or this Website, or (d) which may expose Lakepedia or its affiliates or its users to any harm or liability of any type.

11. Termination

Any use of the Interactive Areas or other portions of this Website in violation of the terms of this Agreement and may result in, among other things, termination or suspension of your rights to use the Interactive Areas and/or this Website.

These Terms (including any modifications, as set forth above) shall remain in full force and effect while you use the website or are a Member. You may terminate these Terms and, if applicable, your Membership at any time, for any reason, by contacting us. By terminating your Membership, you acknowledge and expressly agree that Lakepedia may, in its discretion, irrevocably delete all of your profile content, photos and other content or information you have submitted to the Services, as well as your Membership account information. Lakepedia may suspend or terminate your Membership and/or terminate these Terms at any time, for any or no reason, with or without prior notice or explanation, and without liability. Upon termination of these Terms by you or us, you may no longer access or use the Services in any way.

12. Using the Products or Services of Third-Party Suppliers

This Website may link you to supplier sites or other websites that Lakepedia does not operate or control. Lakepedia is not a travel agency and does not provide or own transportation services or accommodations. Although Lakepedia displays information about properties, products and services owned by third-party suppliers and facilitates contact with certain suppliers, such actions do not in any way imply, suggest, or constitute Lakepedia’s sponsorship or approval of third-party suppliers. Lakepedia does not endorse or recommend the products or services of any third-party suppliers. You agree that Lakepedia is not responsible for the accuracy or completeness of information it obtains from third-party suppliers.

If you use the services of a third-party supplier, you agree to review and be bound by the supplier’s terms and conditions of purchase and site use (the “Terms and Conditions”), Privacy Policy, and any other rules or policies related to the supplier’s site or property. Your interactions with third-party suppliers are at your own risk. Lakepedia will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any third-party suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with third-party suppliers.

13 Fees

Lakepedia reserves the right to charge for any portion of the Services and to change its fees (if any) from time to time in its discretion. If Lakepedia terminates your Membership because you have breached these Terms, you shall not be entitled to the refund of any unused portion of fees or payments (if any).

14. Membership Refunds

Due to the nature of this service refunds can not be given. Once a membership is processed the user has immediate access to all the member benefits. Once a user has access to this information for their use a refund can not be given.

THE INFORMATION, PRODUCTS, AND SERVICES PUBLISHED ON THIS WEBSITE MAY INCLUDE INACCURACIES OR ERRORS, INCLUDING INFORMATION ERRORS, RESERVATION AVAILABILITY, PRICING ERRORS. The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose. The limitations of liability provided in these terms inure to the benefit of Lakepedia.
